Melbourne & Victoria Granny Flat Regulations
Victoria’s new regulations simplify the process of building luxury granny flats.
- Land size: your property must be at least 450 square metres to qualify.
- Setbacks: granny flats must be positioned a minimum of 3 metres from the back boundary and 1 metre from the side boundaries.
- Size limits: the dwelling cannot exceed 60 square meters.
- Occupancy: unlike previous rules, Melbourne’s updated regulations allow granny flats to be rented to anyone, not just dependents of the homeowner.
Although planning permits are no longer required for most small second homes as of December 2023, you will still need a building permit to ensure compliance with safety and building standards.
It’s advisable to work with your local council or a registered building surveyor to confirm your plans align with the rules.
Sydney & NSW Granny Flat Regulations
To build luxury granny flats in Sydney, you need to refer to the local building rules.
- Land size: your land must be at least 450 square metres.
- Setbacks: granny flats need to be 3 metres away from the back and 0.9 metres away from the sides of your property.
- Size limits: the flat cannot be larger than 60 square metres.
Once you start the process, whether with us or someone else, we advise notifying your council of your plans to ensure that you are meeting the rules.
It is possible to still build luxury granny flats that don't meet the above requirements; it's just that a more involved Development Application (DA) is then required.
